As things go forward, there may be additional charges to bring.
Manhattan District Attorney Alvin Bragg on the state of the case against Luigi Mangione, the alleged shooter of UnitedHealthcare CEO Brian Thompson.
What To Know: On December 9th, Luigi Mangione was apprehended in Pennsylvania on state charges related to forgery and carrying a firearm without a license. NYPD authorities say he was found with evidence linking him to the December 4th murder of UnitedHealthcare CEO Brian Thompson. Mangione awaits extradition to New York where he is charged with second degree murder as well as other related offenses in connection with Thompson’s killing.
The Pennsylvania defense attorney representing Mangione, Thomas Dickey, says he has seen “zero evidence” linking Mangione to Thompson’s killing and that his client will be pleading “not guilty.” Mangione has also retained former Manhattan prosecutor Karen Friedman Agnifilo, whose husband is representing Sean ‘Diddy’ Combs, to represent him in New York City.
Why Second Degree? Generally speaking, most murder cases are prosecuted under state law, unless there was a killing on federal land (ex: a military base). Both federal and state laws categorize murders by degrees of severity; however, the precise legal definition varies by jurisdiction. Most jurisdictions define first degree murder as a killing with premeditation and deliberation, but in New York, first degree murder only applies to certain situations, such as the intentional killing of a police officer or a witness to a crime in order to prevent their testimony, or in furtherance of an act of terrorism.
In New York, second degree murder is punishable by at least 15 years in prison, or up to life imprisonment without the possibility of parole.
