Limits placed on NDA’s used for sexual harassment cases

Former Fox News host Gretchen Carlson, whose nonprofit helped push for a bill limiting the use of non-disclosure and non-disparagement agreements in cases of workplace sexual misconduct. The bill has passed in both the House and Senate, and is expected to be signed into law by President Biden.

Why It Matters: Following the #MeToo movement that began about five years ago, this bipartisan legislation is part of a larger push to protect people in circumstances of workplace sexual misconduct. The bill applies to agreements signed before a dispute occurs – such as non-disclosure and non-disparagement agreements signed when starting a new job – and does not apply to other workplace misconduct like age or race discrimination.
