While I’m not entirely sure how things work in Texas, here in New York, a rejection means the matter is closed.
Acting Ulster County clerk Taylor Bruck who refused to file a Texas civil judgment issued against a New York doctor in New York court. Texas says the New York doctor violated Texas law by prescribing abortion medication via telemedicine to a woman living in Texas – a state with some of the most restrictive abortion laws in America.
Why It Matters: This tension between states, and varying state abortion laws, may reflect the next frontier on the legal fight over abortion law in America. Texas alleges New York is breaking the law by not enforcing a civil judgment issued by a Texas court; New York has a “shield law” in place to protect its healthcare providers who provide abortion care via telemedicine from this type of legal action. The question remains about whether Texas will appeal to the U.S. Supreme Court to determine how state abortion laws can or cannot apply across state lines.
