Individuals and businesses will be able to use compensation from the settlement in any manner they see fit to address potential adverse impacts from the derailment.

Norfolk Southern in a statement regarding the decision to settle a class-action lawsuit over the February 2023 train derailment in East Palestine, Ohio.

Why It Matters: Tuesday’s settlement includes a $600 million payout to people impacted by the 38 train cars that derailed in East Palestine, 11 of which carried hazardous chemicals, igniting a huge fire and forcing thousands to evacuate. The company does not admit to any wrongdoing or claim liability for the derailment. The settlement, however, applies to those within a 20-mile radius of the derailment, with those within the 10-mile radius to be eligible for personal injury claims. Payments could begin by the end of this year, pending approval by a federal judge in Ohio.
