Special Counsel: “No Criminal Charges” Against Pres. Biden

Our investigation uncovered evidence that Mr. Biden willfully retained and disclosed classified materials after his vice presidency as a private citizen. … However, for reasons documented below, we conclude that the evidence does not establish Mr. Biden’s guilt beyond a reasonable doubt.

Special Counsel Robert Hur in a 300+ page report summarizing an investigation into the President’s handling of classified material. The special counsel recommend no criminal charges.

Why It Matters: This concludes a year-long investigation into the President for his handling of classified material found in both his private home and an office.

Meanwhile, a special counsel investigation into former President Trump’s handling of classified material led to criminal charges related to allegations of illegally retaining these documents and obstructing the investigation.

President Biden chose to react publicly to the investigation’s conclusion on Thursday night at the White House, defending himself against a comment in the report that made negative suggestions about his age and his ability to remember. Here’s an example from the report, written by investigators: “We have also considered that, at trial, Mr. Biden would likely present himself to a jury, as he did during our interview of him, as a sympathetic, well-meaning, elderly man with a poor memory.”

In that same press availability, Pres. Biden answered questions, vigorously defending himself against pointed inquiries about his age and his ability to remember. Pres. Biden concluded the Q&A, went to leave the room, and turned back to the microphone to answer an unrelated question on Israel and mistakenly said the “President of Mexico” rather than the “President of Egypt” when speaking about humanitarian aid entering Gaza.
